(AP) ? A formal complaint filed with New York's lobbying board asks it to investigate whether Artists Against Fracking, a group formed by Yoko Ono and son Sean Lennon, is violating the state's lobbying law.

The complaint obtained by The Associated Press was made by the Independent Oil & Gas Association to the state Joint Commission on Public Ethics.

The energy trade group based its request for an investigation on an AP report that found that Artists Against Fracking and its advocates didn't register as lobbyists. Registration requires several disclosures about spending and activities.

A spokesman for Artists Against Fracking says the group's activities are protected because they were made during a public comment period. He also says celebrities involved in the group are protected because they are longtime activists, not lobbyists.

Twitter music app reportedly includes Vevo, may expand to more services

As much as we're intrigued by the prospect of Twitter's music app, the rumored emphasis on SoundCloud would potentially limit the selection given major label resistance to giving away ad-free content: we'd expect a lot of DJ sets and indie demos. A supposed leak from AllThingsD has Twitter catering to the less adventurous among us by adding Vevo support. While the full workings of the rumored app remain a mystery, Twitter would reportedly play Vevo's mostly pop-oriented music videos through a custom player. It might not be the only service involved, too: the same tips suggest that Twitter wants to round up multiple services, and the two that have surfaced so far are just the first to hop aboard. We have a hunch that the expanded app (if real) won't make the originally claimed March launch when we're already at the last weekday of the month, but the latest tidbit suggests Twitter is far from giving up on turning microblogs into mini jukeboxes.

US Patent And Trademark Office Denies Apple's iPad Mini Trademark Application, Deemed ?Merely Descriptive?

As Patently Apple noticed earlier today, however, the USPTO has now refused Apple’s trademark filing because, the reviewer argues, “the applied-for mark merely describes a feature or characteristic of applicant?s goods.” The refusal was mailed to Apple on January 24, but only made public in the last few days. “The applied-for mark merely describes a feature or characteristic of applicant?s goods.” The word ‘mini,’ the reviewer argues, just describes that the iPad mini is indeed “a small sized handheld tablet computer” and just describes the mini’s features. It is not, the reviewing attorney says, “a unitary mark with a unique, incongruous, or otherwise nondescriptive meaning in relation to the goods and/or services.” The USPTO would only grant apple the trademark to the full iPad mini name if the company coulhow that the word ‘mini’ has now acquired a “distinctiveness.” In addition, Patently Apple also notes, the reviewer also denied the application because Apple should have provided the USPTO with a specimen other than its own product website, even though Apple always uses these for its trademark applications and this was never a reason for a denial before. The reviewer also believes that there is a “likelihood of confusion” between Apple’s existing iPad trademarks and this new iPad? mini application, which, to be honest, doesn’t make a lot of sense. Tennessee town unites to help make cancer patient's dream come ...

KNOXVILLE, T.N.?Tennessee 14-year-old Katelyn Norman has been battling a rare form of cancer for two years and last week she received word that her chemotherapy treatments are no longer working.

Norman complied a bucket list that included going to the prom, so her family contacted a local school district to make it happen. In only one week, the district planned an impromptu dance at local reception site.

However, by Tuesday afternoon, Katelyn was rushed to the hospital after she was having difficulty breathing. When she couldn?t go to the dance, they brought the dance to her.

According to reports, the hospital staff decorated the room and her date gave her a corsage and a special sash.

Meanwhile, more than 100 people drove to the hospital in Knoxville with escorts from several law enforcement agencies. They even brought a limo to drive by in her honor. Friends and family stood outside her window and formed the shape of a heart.

Back at the original prom site, a celebration of Katelyn still took place even in her absence.

?She contacted me and said prom must go on, that?s her, and you can?t help but feed off that energy, that life,? an instructor at Katelyn?s school and organizer of the prom told WATE.

Katelyn?s courage even prompted the mayor to declare?Tuesday Katelyn Norman day?thousands of people lined a local highway in her honor.

Anyone who would like to send well wishes to Katelyn can send her an e-card at the East Tennessee Children?s Hospital website and volunteers will deliver them to her.

WATE reports that through donations, more than $63,000 have been raised for Katelyn?s bucket list.

Book tells of fight over intervention

"Those Angry Days: Roosevelt, Lindbergh, and America's Fight Over World War II, 1939-1941" (Random House), by Lynne Olson

The bitter feelings that divided the nation during the Vietnam buildup and the Iraq invasion have become fading memories. But far fewer Americans still recall the even more passionate debate over our stance toward Nazi Germany during the first two years of World War II.

That tumultuous time between the invasion of Poland and the attack on Pearl Harbor gave rise to a conflict at home that pitted isolationists against interventionists. Larger-than-life figures, from President Franklin D. Roosevelt to aviator Charles Lindbergh, were leading players in that ferocious battle in which the stakes couldn't have been higher.

In "Those Angry Days," journalist-turned-historian Lynne Olson captures that period in a fast-moving, highly readable narrative punctuated by high drama. It's an ideal complement to her previous books about Britain's Tory rebels who brought Winston Churchill to power and Americans who assisted England while it stood alone against a triumphant Germany.

The question of whether to intervene on Britain's behalf, and even to amend neutrality laws by shipping vitally needed supplies to the beleaguered nation, was one that divided families and friends.

Olson presents as a prime example the poignant story of celebrated author Anne Morrow Lindbergh, who was caught between her husband's leadership of the campaign to keep America out of the war and the efforts of her mother and sister on behalf of intervention.

Roosevelt, according to the author, was overly cautious and hesitant, preferring to follow public opinion rather than lead it. "He was intimidated by congressional isolationists, whose strength he tended to exaggerate, and was loath to challenge them," Olson writes.

Pioneering a tactic that would be used by subsequent presidents, Roosevelt sought to discredit his opponents by questioning their patriotism and went on to enlist the FBI to wiretap their phones and seek derogatory information that could be used against them.

One figure who stands tall is Republican Wendell Willkie, whose break with his party's isolationism strengthened his bid for president. The author conveys the excitement of the 1940 convention that chose Willkie as the unlikely GOP nominee and the campaign that ended with FDR's election to an unprecedented third term.

The book is filled with profiles of fascinating figures on both sides of the debate: syndicated newspaper columnist Dorothy Thompson, a leading voice for intervention; Burton Wheeler, a progressive Democrat who broke with Roosevelt over the war and led the isolationist cause in the Senate; and British ambassador Lord Lothian, who promoted support for his country and helped get the president to devise the Lend-Lease program that kept Britain afloat.

Arrayed against the interventionists were many high-ranking military officers and the America First movement, whose anti-Semitic strains came to the surface in a Lindbergh speech that left him discredited among many Americans who once glorified him.

The fight over intervention mobilized the public to take part in the debate and, in the end, helped to educate Americans about the need to prepare for entry into the war. "It was a robust, if tumultuous, example of democracy in action," Olson writes.

"Those Angry Days" is popular history at its most riveting, detailing what the author rightfully characterizes as "a brutal, no-holds-barred battle for the soul of the nation." It is sure to captivate readers seeking a deeper understanding of how public opinion gradually shifted as America moved from bystander to combatant in the war to preserve democracy.

Obama: Assault weapons ban deserves a vote

President Barack Obama says each of his proposed steps to reduce gun violence should get a vote in Congress ? even an assault weapons ban that both parties agree stands little chance at passing.

Senate Democrats dropped the ban from the bill they plan to debate next month out of concern it could sink the whole package. Still, Obama says he's pushing for it.

In his weekly radio and Internet address released Saturday, Obama says the U.S. has changed in the three months since the December school shooting in Newtown, Conn. He says Americans support the ban, plus limits on high-capacity ammunition magazines, school security funding and a crackdown on gun trafficking.

"Today there is still genuine disagreement among well-meaning people about what steps we should take to reduce the epidemic of gun violence in this country. But you, the American people, have spoken," Obama said.

The White House said Saturday that Obama will make additional trips outside Washington to rally support for the measures, including the assault weapons ban. The White House also said that before Obama left for Israel earlier this week, his push for gun control was among the issues he raised with lawmakers from both parties as he embarked on a concerted effort to reach out to Congress.

In the Republican address, Sen. Mike Lee of Utah says the Senate Democrats' budget raises taxes by $1.5 trillion without doing anything to save entitlements like Social Security and Medicare. He says Republicans want a balanced budget that lives up to the nation's moral obligation to act in the best interest of future generations.

"Republicans recognize that keeping dollars, decisions, priorities and power in the hands of the people is what has made America the greatest civilization the world has ever known," Lee says. "Now is the time to return to that model."

A copy of "Sgt. Pepper's Lonely Hearts Club Band"?autographed by all four Beatles up for auction has already surpassed its estimated price by tens of thousands of dollars, The Associated Press reports.

Bidding began at $15,000 with the Dallas-based Heritage Auctions expecting the copy to sell for about $30,000. Early bidding, however, has already pushed the price to $110,500. The auction itself is set for March 30th, and the house says the price could exceed $150,000 by then.

72% Of Professors Who Teach Online Courses Don't Think Their ...

This is not a good sign for online education: 72 percent of professors who have taught Massive Open Online Courses (MOOCs) don?t believe that students should get official college credit, even if they did well in the class. More importantly, these are the professors who voluntarily took time to teach online courses, which means the actual number of professors who discount the quality of MOOCs is probably much (much) higher. The survey reveals the Grand Canyon-size gap between the higher-education establishment and the coalition of tech companies and lawmakers that are mandating college credit for online courses.

Since the largest university system in the world, the California State University system, announced a pilot for low-cost online lower-division courses, schools from all over the country have raced to replace physical college instruction at a crazy fast pace. In only a month?s time, the University of Wisconsin started offering a fully legitimate college degree without any class time required and scores of schools announced that they will be emulating CSU lower-division pilots in the near future.

But, this is mostly administration-driven. Professors, by and large, are freaking out. When the California state legislator proposed mandating that online courses be accepted, the faculty senate sent a strongly worded letter to lawmakers:??There is no possibility that UC faculty will shirk its responsibility to our students by ceding authority over courses to any outside agency?

This latest survey from The Chronicle Of Education reveals how little confidence professors have in their own courses. ?The deck was somewhat stacked with true believers,? writes Steve Kolowich of The Chronicle about the survey, which polled the 184 known professors who have taught a MOOC.

It?s early days for online education, and the old guard isn?t going down without a fight.

FCC Chairman Julius Genachowski to step down 'in the coming weeks' (update: his departing words)

STUB FCC Chairman Julius Genachowski formally announces his departure

Julius Genachowski will be stepping down when he reaches the end of his term as FCC Chairman, according to a brief message on the FCC's webpage. We're expecting to hear more in a live announcement at 10am, but this was no big surprise: four-year terms are the norm for a chairman and it was widely expected that he'd be amongst the officials replaced during Obama's second stint in office. The Wall Street Journal actually broke the news yesterday, and speculation over Mr. Genachowski's tenure has lingered ever since an awkward exchange where he refused to commit to his future at this year's CES.

During his time at the Commission, Genachowski worked to speed up the roll-out of broadband to rural communities, voiced concerns about the current phone unlocking policy and pushed to allocate more spectrum to WiFi use. With senior Republican Robert McDowell also departing the commission in the next few weeks, two places on the FCC's five-person board will need filling -- with names like Tom Wheeler, Karen Kornbluh and Catherine Sandoval being bandied about as replacements.

Update: Genachowski just made his formal announcement and used his minutes on the podium to thank the FCC's staff for helping to "get big things done" and "improve the lives of all Americans." He says the US has gone from "laggard to leader" in telecoms, with as many 4G subscribers as the rest of the world combined.

Depending on who you ask, the stock market is: a) overbought, b) a bubble, c) poised to go much higher, d) on the cusp of a correction, e) anything else you could possibly think of and then some. Whenever a range of opinions is this wide and passions this high, it's a great time to step back and take a look at the charts. Charts don't care how you personally feel or what you hear at the cocktail party. That's one reason pros tend to use them; whether they admit to it or not.

As the co-founder of ChartLabPro.com Greg Troccoli has been using price charts to guide his trading for more than a quarter of a century. In the attached clip he shares his strategy for playing the S&P 500's next move.

Troccoli describes himself as bullish overall but he's keeping a tight leash on his positions. "You could go down to the 200-day moving average line and not change the overall four-year trend and go all the way to 1,440," he says.

Such a move would be not dissimilar to what happened last year when stocks got off to a torrid start in the first quarter only to give the gains back in a tough Q2. A move to 1,440 would leave stocks up less than 2% for 2013.

The beauty of technicals is that Troccoli isn't relying on his gut or the latest news from Cyprus to inform his decision. He's listening to the market rather than making a negative forecast. "I don't really start to turn negative unless we close, not intra-day, but close below 1,535."Stocks have made multiple runs at new highs in recent days. For those keeping score at home there is a "triple top" in the mid-1560 area. Should that give way and close above the 1570 area Troccoli's work suggests a move much higher than anyone might think is in the cards.

Beware of fake Homeland Security emails

WASHINGTON (Reuters) - The U.S. government on Thursday warned computer users to beware of fake emails they may receive from hackers claiming to be from the Department of Homeland Security and demanding money to reinstate use of their computer.

Homeland Security's U.S. Computer Emergency Readiness Team, or US-CERT, published an alert on its website warning it had received reports of DHS-themed "ransomware."

"Users who are being targeted by the ransomware receive an email message claiming that use of their computer has been suspended and that the user must pay a fine to unblock it," the warning said, adding that the ransomware falsely claims to be from the department and its National Cyber Security Division.

Ransomware is increasingly widespread malicious software that purports to encrypt a user's files and then demands payment to unlock them.

US-CERT urged users and systems administrations to use caution if they find a questionable email message that could contain the ransomware. It said to urge users not to click on the messages or submit any information to Web pages.

Fox picks up Big East basketball for 12 years

(Reuters) - Fox Sports has signed a 12-year contract to carry the new Big East basketball conference, the first major sports rights agreement it has entered since announcing its new national cable channel to compete with ESPN.

Terms of the deal were not disclosed. A source close to the matter estimated the deal was worth between $500 million and $600 million over the 12 years. Fox, owned by News Corp, has been buying sports rights to showcase on its new cable network, dubbed Fox Sports 1, which will debut in August.

The newly constituted conference will add Butler, Creighton and Xavier to the so-called "Catholic 7" schools - Georgetown, Marquette, Providence, St. John's, Seton Hall, Villanova, DePaul - which are starting a league July 1 called the "Big East".

The seven schools broke from the Big East conference, but will retain the conference's name and branding for their league. The former conference known as the Big East will be re-named shortly. That conference signed a multiyear basketball and football contract with ESPN on Tuesday.

As part of the agreement, Fox will have the rights to all of the conference basketball games, some women's basketball games, Olympic sports and other content.

Fox Sports 1 will televise more than 100 regular season games as well as the Big East tournament. The deal includes digital rights as well which will be tapped for the Fox Sports Go app for mobile devices.

The sports cable channel already has rights to college football and basketball from other athletic conferences, Major League baseball games, Nascar, Ultimate Fighting Championship and soccer. Fox executives have said that the new network is on the hunt for other sports deals.

Fox joins media companies from NBC to Al Jazeera in chasing the advertising dollars that flow to live sports programming. These channels also collect monthly subscription fees paid by cable operators that generate a steady stream of revenue.

News Corp shares were trading 33 cents higher by 1.1 percent at $29.96 per share on Wednesday.

Despite pleas by Craigslist killer's mother, Ohio jury recommends death penalty

An Ohio jury convicts a man accused of luring job seekers to a remote farm where they were robbed and killed. WKYC's Sara Shookman reports.

Begging to have jurors spare her son's life, the mother of a triple killer who lured his victims with Craigslist job offers testified Wednesday that he had a troubled childhood and suffered physical and sexual abuse.

"I love Richard with all my heart," a teary-eyed Carol Beasley testified during the sentencing phase of the trial of her son, 53-year-old Richard Beasley. He was convicted last week of killing three men and wounding a fourth, all lured with offers of farmhand jobs in southeast Ohio in 2011.

But despite the emotional plea, the jury on Wednesday evening recommended the death penalty for Beasely. Other options were life in prison without the chance of parole or life with a chance for parole after 25 or 30 years.

Judge Lynne Callahan, who has final say in Beasley's fate, said on Wednesday she will sentence him on March 26.

Beasley's co-defendant, then 16 years old, is too young to face the death penalty. Brogan Rafferty was sentenced to life in prison without the chance of parole on his conviction last year.

In an opening statement at the sentencing part on Wednesday, prosecutor Jonathan Baumoel said the "enormous" weight of Beasley's crimes should be considered in deciding on life or death.

The defense responded by calling witnesses to portray Beasley sympathetically. As his mother testified, Beasley slumped forward, his chin on his chest and his right hand covering his eyes.

She described a difficult childhood for her son, with a verbally and physically abusive stepfather whom Carol Beasley characterized as a mean drunk.

She testified that she learned only within the past year that her son had been sexually abused by neighborhood youngsters when he was a boy. She had known that the boys had forced him to remove his pants in a large drainage pipe but hadn't known about the abuse at the time, she said.

"I always felt there was much more than he told me," she testified. Her son apparently kept the abuse secret out of fear he would be held responsible for it, the mother said.

Her first husband neglected Richard and her, Carol Beasley testified, and her second husband broke dishes and a window while drinking and whipped Richard as a toddler.

"Richard was very mistreated by him," she testified.

Carol Beasley testified that Richard and the couple's own two daughters would be put to bed early and sometimes were sent to relatives for the weekend to avoid contact with the father.

"Everybody was afraid when he came home," she said.

The defense also called a psychologist, John Fabian, who testified that Beasley suffers from depression, alcohol abuse, low self-esteem and a feeling of isolation, all possible results of a troubled, abusive childhood.

"These are all potential mitigating factors" in favor of leniency, Fabian testified.

Fabian said Beasley's issues should be considered in multi-generational terms involving him and his family life. "This is all his personality development," he said.

One of Beasley's victims was killed near Akron, and the others were shot at a southeast Ohio farm during bogus job interviews.

The slain men were Ralph Geiger, 56, of Akron; David Pauley, 51, of Norfolk, Va.; and Timothy Kern, 47, of Massillon.

The survivor, Scott Davis, testified that he heard the click of a gun as he walked in front of Beasley at the reputed job site. Davis, who was shot in an arm, knocked the weapon aside, fled into the woods and tipped police.

Beasley, who returned to Ohio from Texas in 2004 after serving several years in prison on a burglary conviction, testified that he met with Davis and Davis had pulled a gun in retaliation for Beasley serving as a police informant.

Osborne raises some cheer with beer duty cuts

LONDON (Reuters) - Chancellor George Osborne scrapped the country's above-inflation beer tax rises on Wednesday and cut 1 pence off a pint, cheering drinkers and providing some relief for a pub sector still enduring 18 closures a week.

The much criticized beer duty escalator, put in place to push the levy up 2 percent on top of inflation every year until 2015, has seen the tax on beer increase 42 percent since the previous Labour government introduced it in 2008.

It means that more than a third of every pint pulled in a pub is now paid in duty and value-added tax (VAT).

"We will now scrap the beer duty escalator altogether, and instead of the 3 pence rise in beer duty tax planned for this year, I am cancelling it altogether," Osborne announced to big cheers in parliament.

"That's the freeze people have been campaigning for but I am going to take it one step further and I am going to cut beer duty by one pence. We are taking a penny off the pint."

The cuts will spare squeezed consumers another hit at a time when austerity measures and low wage growth are reducing discretionary spend and forcing pub companies to compete hard among each other and with much cheaper supermarkets.

Shares in Wetherspoon rose 3.4 percent to 544.5 pence on the news, while Enterprise Inns was up 2.6 percent at 112.85 pence at midday.

The British Beer & Pub Association said it was great news: "In abolishing the beer tax escalator, the chancellor has ended a hugely damaging policy that would have made Britain's beer the most heavily taxed in Europe," BBPA Chief Executive Brigid Simmond said.

Since the duty escalator was introduced in 2008, 6,000 pubs have shut and an average of 18 are still closing every week.

Recent research has said scrapping the escalator will save over 5,000 jobs in an industry that employs almost 1 million people. A study by Oxford Economics has also suggested that, despite a slight drop in beer duty revenue, the move will raise an additional 5 million pounds in revenue through higher employment tax contributions and reduced unemployment payments.

Osborne said the 1p cut would take effect this Sunday night. Ted Tuppen, chief executive of Enterprise, welcomed the news and said the benefit would be passed onto its customers immediately.

Not everyone was happy, though.

Osborne maintained a planned rise for all other alcohol duties, meaning wines and spirits will see above-inflation tax rises for a fifth straight year. Diageo said the British spirits maker was being punished for its success in a harsh economic climate.

Russian Orthodox activists denounce evolution at Moscow Museum

MOSCOW (Reuters) - Russian Orthodox religious activists festooned a Moscow museum named for Charles Darwin with banners and leaflets denouncing evolution theory in a display of disdain for secular education.

The incident on Sunday at the Darwin natural history museum named for the Victorian British naturalist who expounded the theory of natural selection was a non-violent but bold attack on secular traditions that remain strong despite a post-Soviet revival of the Russian Orthodox Church.

Footage released by Orthodox activist group Bozhaya Volya, or God's Will, showed activists unfurling a banner reading "God created the world" on the building's facade while others threw leaflets bearing creationist slogans into the lobby of a popular destination for school trips and family outings in the capital.

"God created kittens!" read one leaflet visible in the video, which also featured activists holding banners disparaging the theory of evolution as a "pseudo-scientific myth" and singing religious songs.

"Checkmate atheists! In the year 7522 since the creation of the world, creationists have seized the Darwin museum," a member of the group which advocates "the revival and development of Russia as an Orthodox Empire" said on Twitter.

Moscow police said they had not received any complaints from the museum about the incident. The museum, which is closed on Mondays, could not immediately be reached for comment, and the Russian Orthodox Church could also not immediately be reached.

About two-thirds of Russians consider themselves Russian Orthodox and the church has gained influence since the 1991 collapse of the Soviet Union, drawing concern from critics who say it is too powerful in a secular state.

Tension between Russian Orthodox activists and secular liberals has increased in recent years.

Activists have occasionally vandalized art exhibits they have denounced as blasphemous, while two women from the band Pussy Riot were convicted of a religious hate crime for a "punk protest" in Moscow's main cathedral in February 2012.

The women, who urged the Virgin Mary to rid Russia of then Prime Minister Vladimir Putin, are now serving two-year prison terms.

The singers said they had not meant to offend the faithful, only to lampoon the church's ties to Putin, who was praised by Russian Orthodox Patriarch Kirill during his successful campaign to win a third presidential term weeks later.

Getting past America's retirement blues

CHICAGO - The economic recovery is not helping Americans shake a bad case of retirement anxiety.

Workers and current retirees are less confident than ever in their ability to live comfortably in the post-employment world, according to the 2013 Retirement Confidence Survey published Tuesday by the nonprofit, nonpartisan Employee Benefits Research Institute.

But the survey also shows that the retirement blues may be due not only to the Great Recession's aftermath, but also to a widespread lack of planning and unrealistic guesswork by individuals about how much they need to save.

The EBRI survey stands out from the dozens of other retirement surveys for its longevity. Now in its 23rd year, it gives a measurable long-range view of American attitudes about retirement. This year's results show historically high worry about retirement security among workers and current retirees.

"Confidence dipped after 2007, and it's been sliding since then," says Nevin Adams, co-director of the EBRI's Center for Research on Retirement Income.

The EBRI surveyed 251 retirees and 1,003 workers, ages 25 and older in January. Some of their worries:

* Just 24 percent of current retirees are confident about their ability to meet basic expenses, down from 35 percent in 2011.

* More than half of the surveyed workers have saved less than $25,000 for retirement (excluding the value of their home and any traditional defined benefit pension). And just 24 percent of households with incomes of less than $35,000 have managed to put away any sum of money at all, down from 49 percent back in 2009.

* Employment worries are paramount. Current workers and retirees both cite job uncertainty as the biggest problem facing Americans.

* More people expect to rely on Social Security. Seventy percent of retirees call it a "major source" of income, up from its recent low of 55 percent in 2007, before the recession and stock market decline began.

* People expect to work longer. Thirty-six percent of workers expect to stay on the job past age 65, up from 11 percent back in 1991. Meanwhile, the percentage of workers expecting to retire before age 65 is now half what it was two decades ago: down from 50 percent in 1991.

All these numbers point to the profound damage wreaked by the recession, joblessness and wage stagnation. But the survey also points to another problem: Workers and retirees seem to lack the planning skills and the information to figure out what they need to save and how to save it.

For example, less than half (46 percent) of survey respondents have tried to calculate the assets they will need for retirement. The numbers are only slightly better among workers closer to retirement.

As a result, savings goals often are unrealistically high. One-fifth of workers say they need to save between 20 percent and 29 percent of their income each year, and 23 percent indicate they need to save 30 percent or more. The average savings rate in 401(k) plans is 8 percent, according to a recent study released by Fidelity.

But the lack of planning goes beyond saving; it also means many of us have not really projected retirement expenses. Instead, people are guessing, or relying on misleading rules of thumb promulgated by the financial services industry - namely that we all will need at least 80 percent of pre-retirement income, if not more, in retirement.

These rules of thumb are what I called "rules of dumb" even before the recession. Now it is more important than ever to get a realistic projection.

This requires some effort, but it is not rocket science. Start by penciling out actual nondiscretionary expenses in retirement, like housing, food, utilities and transportation. Remember that when you stop working, some expenses disappear: commuting, work wardrobes, lunches out - and saving for retirement itself.

Compare your expense projection with what you can count on from Social Security (it will be there), pensions (if any) and a conservative annual drawdown of your savings (say, 3 percent in the first year plus an annual adjustment for inflation).

If those two columns do not match, by all means try to save more, but also sharpen up the pencil and think creatively about ways to reduce expenses. You may want to downsize to less-expensive housing or eliminate other nonessential spending.

The Internet is littered with expense calculators that can help get you started. But the classic book on the subject is "Retire on Less Than You Think" (Times Books) by Fred Brock, the former retirement columnist of The New York Times. Brock concludes that most of us can retire on far less than the rules of thumb suggest, if we are willing to get creative.

In this economy, a little creativity could just carry you a long way into retirement.

Man suspected in NYC woman's death nabbed in Syria

ANKARA, Turkey (AP) ? Istanbul's police chief says a man suspected of killing a New York City woman in Istanbul was caught in Syria in a joint operation by Syrian rebels and Turkish officials.

Huseyin Capkin contradicted a statement by the interior minister who had said the suspect was detained at the border as he entered Turkey.

Istanbul Governor Avni Mutlu says the suspect has confessed to killing Sarai Sierra, whose body was found in Istanbul on Feb. 2, days after she was reported missing during a solo vacation. Authorities say she died of a blow to the head.?

A video reportedly recorded in Syria, and posted on Hurriyet newspaper's website, shows the purported suspect saying he was under the influence of paint thinner during the incident.

Turkish news reports have described him as a homeless scrap paper collector.
