Carl Downer, Announcer At London's Victoria Station, Makes Commuters Smile (VIDEO)

The London Underground's most popular announcer will totally make your day.

For six years, Jamaica-born Carl Downer has shared Rastafarian wisdom with strangers passing through central London's Victoria Station in order to cheer them up, according to Yahoo News. His performance, which sometimes references MC Hammer, was caught on video this week.

?Chill out, kick back, no need let anybody cramp your style,? he says in the YouTube clip above. ?Rastaman driver, take these beautiful people to their destination."

In an interview with Vice Magazine, Downer explained why he does it.

I feel happy when people smile because of me. You know why? With the economy nowadays, you don't know what people are going through, and if they can take their mind off all the things going on in their personal life, in their job life, that one moment of happiness can make a big difference.

He added, "I like to see people happy, man ?- seriously."

We'd like to transport this dude to New York City.

Watch Part 2 of the video below.

Want to win Twitter friends? Stay short, cheery

Twitter audiences need to be tended to carefully, like a garden with young plants (but hopefully less dirt). There?s all kinds of anecdotal advice about how to be a better tweeter, but now a new study says that the twittizens who grow the most audiences tend to share short, clear, informative tweets.

If most of your followers don?t know you, personal tweets aren?t the best way to go, C.J Hutto, one of the researchers of the group from Georgia Tech, told NBC News. "The ties between people on Twitter are weaker than between people in real life, or on Facebook," he explained.

People are mostly looking for information, the team observed. "Rather than talking about what you had to eat for breakfast or lunch you can talk about an interesting news article that you read," Hutto said.

Hutto and his colleagues scrutinized half a million tweets that 507 people had sent over more than a year. They recorded the length, clarity, and general tone of the tweet. They counted how often the tweeters used hashtags, linked to a website, or used a phrase like "RT" or "HT." They then matched all those numbers against friends and follower counts measured at various times during the course of those 15 months.

What else did they find? Using @-mentions and replies helps build a dedicated following, rather than just a stream of tweets addressed to no one. "Imagine an old professor standing in a lecture hall and broadcasting his lecture, versus direct communication," Hutto explained. "When you're talking to one person it helps you grow your audience."

Also: Bad news or negativity of any kind doesn't do so well. That includes swearing, even a frowning face emoticon. And, clarity is a big bonus. Using full sentences rather than abbreviations as you might on text messages goes a long way in convincing a potential new follow that you are a real person. ?Twitter users apparently seek out well-written content over poorly written content when deciding whether to follow another user,? the team writes. If you stick to a topic, that helps too ? something other researchers have also found.

If you tweet often, perhaps you knew most of this already. But if you're looking to get your numbers up, consider this as free advice.

Moody's revises 2013 airport outlook to stable

(Reuters) - Moody's Investors Service on Wednesday said it revised its 2013 outlook for the U.S. airport sector to stable from negative as the rating agency said it expects the airports to maintain the financial performance achieved last year.

Moody's said the outlook on the airports sector has been negative since August 2008. However the agency said that the uncertainty of federal funding remains a negative for airport credit quality.

"Although the long-term FAA reauthorization bill passed in 2012 provides for stable funding levels, these levels are currently exposed to across-the-board cuts from sequestration, debt ceiling, or budget negotiations," Moody's said.

"The outlook for the U.S. airport sector is stable due to projected modest economic growth in the U.S. and global economies that should support enplanement and subsequent revenue increases," the rating agency said in a statement.

The stable outlook also reflects strengthened airport finances, and better than expected operating results in 2011 and 2012, Moody's said.

Airline financial strength has increased, reducing the risk of sudden declines at the airports and supporting a stable outlook, Moody's said.

Fewer seats and higher fares as airlines continue to consolidate will make enplanement growth difficult, Moodys said.

Moody's expects enplanement growth to be about the same rate as gross domestic product growth, or roughly 2 percent.

Complaints on U.S.-led Afghan troops to be checked, Kerry says

LONDON (Reuters) - U.S. Secretary of State John Kerry said on Monday complaints against Afghans working for U.S. special forces in Afghanistan would be investigated, a day after Afghan President Hamid Karzai ordered U.S. troops to leave a critical battleground province.

Karzai's spokesman on Sunday said Karzai had decided that all U.S. special forces must leave Wardak province within two weeks, after accusations that Afghans working for them had tortured and killed innocent people.

The move could further complicate talks between the United States and Afghanistan over the presence of American troops in the country once most NATO forces leave by the end of 2014.

"With respect to Afghanistan and Wardak province, I understand the concerns that they have expressed. And appropriately, any complaints that they may have ought to be appropriately evaluated, and they will be, I can assure you," Kerry told reporters during a visit to London.

Kerry said it was up to the NATO-led International Security Assistance Force (ISAF) to investigate. On Sunday ISAF said it was aware of the allegations of misconduct but would not comment further until it had spoken to Afghan officials.

In Washington, a U.S. defense official said no ISAF troops themselves were involved in any misconduct, as earlier Afghan statements had alleged.

"In recent months, a thorough review in cooperation with the Defense Ministry and National Directorate of Security has confirmed that no coalition forces have been involved in the alleged misconduct in Wardak province," the official said.

"Because we take these allegations seriously, ISAF and Afghanistan officials have agreed to a joint commission to look into the current concerns of citizens in Maidan Wardak."

Relations between Karzai and his international backers have at times been fraught, with the Afghan president warning that civilian deaths could sap support for foreign troops and fuel the insurgency.

Earlier this month, Karzai said Afghan security forces would be banned from calling for NATO air strikes in residential areas after 10 civilians died in one such strike.

Karzai's anger over the conduct of Afghan troops working with ISAF raises the pressure on Afghan forces as they increasingly assume control of security.

NATO and its partners are racing against the clock to train Afghanistan's 350,000-strong security forces, though questions remain over how well the Afghans will be able tackle the insurgency in the face of intensifying violence.

Kerry said Karzai had "many legitimate evaluations" of where things have gone wrong or could be improved but indicated that negotiations on transition and an agreement on the presence of some U.S. troops in Afghanistan after 2014 were going well.

"We're working on a bilateral security arrangement; we're working on this transition process. We've had a very good conversation with the President (Karzai) in the last days," Kerry said.

Samsung Homesync - hands-on with the Android-powered TV box

As a global electronics giant, Samsung has presence in every room in the home, most notably the living room -- the company recently claimed to be selling three TVs every second. And as we all know, Samsung currently dominates the Android smartphone landscape. So it was only a matter of time before the Samsung TV and Android worlds collided.

At Mobile World Congress this week we got our first look at Samsung's Homesync, a 1-terabyte TV box with a Google Play-certified Android front-end. Homesync delivers a full Android experience, with a TouchWiz-based UI that actually scales up really well to the big screen. The main view is a grid of running windows, and you've also got a standard app drawer view, along with on-screen keys you can hit using your pointer.

Consumer confidence is up, but will they spend?

NEW YORK (AP) ? Americans are more confident in the economy than they have been in the past few months, but that doesn't mean they're willing to spend more money.

Consumer confidence rebounded in February, reversing three straight months of declines, as Americans get more used to the higher Social Security payroll tax, The Conference Board, a private research group said Tuesday.

But the rosier outlook follows major companies from Burger King to Wal-Mart that have cautioned in recent weeks that Americans are pulling back on their spending as they try to stomach their smaller paychecks since the tax rose by 2 percentage points last month.

Robert Zamora, who lives in Boston, says while he feels encouraged that the value of his home and his stock portfolio are rising, he's decided to spend less because of the higher payroll tax, which has reduced his monthly income by $250.

"There is no more discretionary money to go around for anything other than the basics," says Zamora, who works in web development for a financial services firm.

The way Americans feel about the economy has gone through peaks and valleys as they've tried to reconcile improving stock and housing markets with new economic challenges. In addition to the higher payroll tax, gas prices are rising and there are worries that lawmakers won't resolve a budget impasse that threatens to trigger $85 billion in spending cuts starting Friday.

The Conference Board's index is closely watched by economists because it attempts to keep a monthly pulse on how Americans are feeling about everything from their jobs to their incomes. That's important because when Americans feel good, they spend. And since consumer spending accounts for 70 percent of U.S. economic activity, the economy benefits greatly when Americans feel good about it.

The January reading shows that Americans are more confident, but still skittish. Confidence rose to 69.6, up from a revised 58.4 in January and the 60.5 analysts polled by research firm FactSet expected. That's the highest reading since November's of 71.5, but well below the 90 that indicates a healthy economy.

The Conference Board's survey, which was conducted from Feb. 1 through Feb. 14 on a sample of 2,300 shoppers, shows that Americans are particularly upbeat about their job and income prospects. But that's coming off gloomier numbers over the past three months. The number of people anticipating more jobs rose to 16.7 percent from 14.4 percent, while those expecting their incomes to increase rose to 15.7 percent from 13.5 percent.

"Consumers are feeling better, but they don't feel a whole lot better," says Mark Vitner, an economist at Wells Fargo.

There's no wonder Americans are torn between positivity and angst. There's a mix of good and bad economic news.

Stocks have roughly doubled since June 2009. And the job market, while still tough, also is rebounding: In January, employers added 157,000 jobs. Still, the unemployment rate rose to 7.9 percent from 7.8 percent in December.

But whether or not Americans open their wallets and pocketbooks may rely on a few economic wildcards. One of them is gas prices, which started to climb in mid-January. As of Tuesday, they are $3.78 per gallon, 40 cents higher than they were a month ago. If gas prices keep climbing, that could squeeze Americans, particularly those already living paycheck to paycheck.

And many economists worry that the budget fights in Washington could really hurt Americans' confidence. They worry that the impasse could persist for much of this year, and be drag on economic growth and Americans' willingness to spend.

Zamora, the Boston resident, certainly frets about how lawmakers are going to resolve the budget crisis.

"Nobody knows what the ripple effect will be," he says. "I don't want to be caught blowing in the wind."

The Finnish Love Themselves Some Dallas Dirt: Kari Lehtonen's ...

My house of the week for my CultureMap Dallas column was goaltender Kari Lehtonen?s University Park shocker over on Bryn Mawr: very ?presidential? Georgian on the outside, a total?knock-your-socks-off contemporary stunner on the inside complete with a huge glossy pea green desk! Turns out the Finns are going gaga over the listing, or maybe Kari! In any case, Jennifer Chininis at CultureMap Dallas tells me traffic for the story is coming in from Finland like crazy. Who knows, maybe we can sell them some MORE Dallas homes: I sure would like to know what they are saying about us!

This is one of Julie Provenzano?s ?Star? listings at?3230 Bryn Mawr Dr.?Built by?Gage Homes in late 2009, the home is 6,400 square feet of pure, clean lines and classic floor plan: foyer, sweeping staircase, living on the left, dining on the right, and kitchen and den straight ahead. A well-done layout sure lets in the light, and the lot is a UP hefty at 70-by-106. There is a?bar with wine grotto, full butler?s pantry that is practically a pastry kitchen, and an enormous and well-engineered kitchen. The study off the living room with that pea green desk is connected by three glass doors for optional entertainment?flow?and streaming sunlight.

The bedrooms, including the huge master suite with breakfast bar, are all upstairs. Each of the three guest bedrooms has its own bathroom, plus there?s a game room over the garage. The third floor has been finished out as a fifth guest bedroom. And in case Kari is ever caught by an errant hockey puck, there is a shaft for a future elevator. This puppy is only $2,395,000 and turns out it was styled by the same interior designer spruced up Loui Eriksson?s baby?s-butt smooth contemporary in Preston Hollow.

About that designer: I am hunting her down, even if I have to go to Finland to find her. My furs are in need of a good work-out!

Much needed test for river blindness infection developed

Feb. 21, 2013 ? Scientists at The Scripps Research Institute (TSRI) have found a telltale molecular marker for Onchocerciasis or "river blindness," a parasitic infection that affects tens of millions of people in Africa, Latin America and other tropical regions. The newly discovered biomarker, detectable in patients' urine, is secreted by Onchocerca volvulus worms during an active infection. The biomarker could form the basis of a portable, field-ready test with significant advantages over current diagnostic methods.

"There has been a need for an inexpensive, non-invasive test that can discriminate between active and non-active river blindness infections during treatment campaigns," said Kim D. Janda, who is Professor and Ely R. Callaway, Jr. Chair in Chemistry, member of the Skaggs Institute for Chemical Biology, and director of the Worm Institute of Research and Medicine at TSRI. "We think that this new biomarker can be the basis for such a test."

The work is described in an online Early Edition of the Proceedings of the National Academy of Sciences during the week of February 25, 2013.

Leading Cause of Vision Loss

A leading cause of vision loss, Onchocerciasis infections are transmitted among humans by river-dwelling blackflies in tropical regions. The vast majority of cases occur in sub-Saharan Africa, although pockets of endemic infection exist in Yemen and in Central and South America. The major symptoms of the disease, including blindness, result from the spread of O. volvulus "microfilariae" -- early-stage larval worms -- to the eyes and other tissues, where they trigger damaging inflammatory reactions.

Mass treatment campaigns, begun in the 1990s, have used the anti-worm drug ivermectin, as well as the antibiotic doxycycline, which kills a symbiotic bacterium within the worms. The World Health Organization's African Programme for Onchocerciasis Control has set a target date of 2025 for the eradication of the disease in that region. But Onchocerciasis treatment is seldom effective immediately, and often spares adult worms. The latter can remain in protected nodules under the skin of a patient and secrete microfilaria for a decade or more. Health agencies need better diagnostic methods not only to monitor the progress of Onchocerciasis treatment campaigns, but also to limit the use of ivermectin and doxycycline to reduce the risk of resistance.

Current diagnostic methods include the painful cutting of "skin snips" from patients for microscopic analysis, and an ELISA antibody test for microfilariae, which may yield positive results even for non-active infections. "You can still have circulating antibodies to a nemotode antigen in your blood for a long time after the infection is gone," said Janda.

Looking for a Better Way

A better diagnostic marker would be a metabolite of O. volvulus that appears only during an active, microfilariae-producing infection and that could determine both the presence and the severity of disease. In 2010, Janda's laboratory demonstrated the feasibility of this approach by sifting through the small-molecule metabolites within blood samples from river blindness patients -- a technique called "metabolome mining" -- and finding a set linked to active onchocerciasis infection. For the new study, the team sought a simpler set of biomarkers -- or better yet a single unique biomarker in urine.

Daniel Globisch, a postdoctoral fellow in the Janda laboratory, started with samples of urine from onchocerciasis-infected and non-infected Africans. Using a powerful laboratory technique called liquid chromatography mass spectrometry, he measured the concentrations of hundreds of small-molecule metabolites in the samples. Excitingly, between the infected and non-infected urine samples, one difference stood out clearly: "An unknown small molecule was highly elevated in the samples from infected individuals," said Globisch.

In a process akin to looking for the proverbial needle in the haystack, Globisch was able to purify the mysterious metabolite, and, using mass spectrometry, determine the chemical identities of its individual pieces. "The metabolite itself wasn't present in the databases, so I searched the literature for what is known about the biosynthesis and metabolic pathways in these nematodes," Globisch said. Ultimately, he was able to identify the metabolite as N-acetyltyramine-O,?-glucuronide. Remarkably, this molecule's inception can be traced to O. volvulus as a neurotransmitter molecule that is secreted by young, reproducing worms and then modified by the human body on its way to being excreted in urine.

"It's a spectacular find in terms of biomarkers as it does not occur naturally in humans," Globisch said. Levels of the metabolite in a non-infected North American control sample were near zero.

Toward a Field Test

In urine samples from Africans with active onchocerciasis infections, Globisch found that levels of the biomarker were on average four to six times higher than in samples from Africans with non-active infections. In a separate test, the team determined that a full course of doxycycline treatment, which sterilizes or kills infecting worms by destroying their symbiotic bacteria, also reduced levels of the biomarker to near-normal. "This biomarker appears to be specific for an active infection," Globisch said. The wide gap between biomarker levels in active and non-active infections suggests that a field test based on the biomarker would be robustly useful.

Such a diagnostic, said Janda, might ultimately be a simple urine dipstick test, much like a home pregnancy test, which would indicate the amount of the O. volvulus biomarker present in the sample. "Ultimately for this to be of value in Third World countries we will need to morph this biomarker into something that's inexpensive, simple to use, tolerant of extreme temperatures and portable -- basically distilling our finding to a test that can be carted around in a backpack," Janda said.

Importantly, he adds that Globisch's metabolome-mining approach in theory should be applicable to the development of diagnostic tests for other worm diseases.

Other contributors to the study, "Onchocerca volvulus Neurotransmitter Tyramine is a Biomarker for River Blindness," were Amira Y. Moreno, Mark S. Hixon, Ashlee A. K. Nunes and Judith R. Denery of TSRI; and Sabine Specht and Achim Hoerauf of the University Hospital Bonn, Germany.

The study was funded by WIRM, which was established at TSRI through a generous donation by John J. Moores.

Google Launches Improved Spell Checker For Chrome And Docs

chrome_beta_logoWith the release of the latest Chrome Beta today (version 26), Google is rolling out?a new spell checker inside its browser and on Google Docs. The new version features support for three additional languages (Korean, Tamil and Albanian) and a number of other improvements. The most important new feature, however, is that users who sync their Chrome settings between devices can now also sync their custom dictionaries across all of their machines, so "you won?t need to teach that new Chromebook how to spell your name" (or remind it that the hot startup you're writing about really doesn't have any vowels in its name).

Samsung Galaxy Xcover 2 hands-on: a ruggedized smartphone with Android Jelly Bean onboard

Samsung Galaxy Xcover 2 handson

It's gotten a bit drowned out in all the Note 8.0 fanfare, but there's another notable member of Samsung's Galaxy being shown off here at MWC 2013: the Xcover 2. Announced late this past January, the Android Jelly Bean (4.1.2) handset is a 4-inch ruggedized device made for active lifestyles. To that end, it bears IP certification for dust- and water-proofing (up to 30 minutes at a depth of one meter). Understandably, its spec load is modest, with a dual-core 1GHz processor (unspecified), 1GB RAM, 800 x 480 display, 4GB storage (expandable via microSD) and 1,700mAh battery.

Since the Xcover 2's meant to be taken outdoors, its body is rife with notches and grips -- so it won't slip out of your hand. The dimpled plastic back, similar to that on the Galaxy Nexus -- has a wrap-around illusion and can only be pried off by turning the lock at its base. Ports for microSD, SIM and 3.5mm headphone jack are all covered by protective flaps, as you'd imagine.

We couldn't get confirmation on the exact CPU inside the Xcover 2, but take our word for it: performance is sluggish. Effect any of the hard Android navigation keys on the bottom and you'll notice a bit of lag before the OS kicks into action. It's to be expected for a device of this nature -- most users eyeing the Xcover 2 likley aren't keen on top-end specs and high-performance. Samsung still hasn't clarified just where or when we'll be seeing the handset crop up, so stay tuned. In the meanwhile, check out our gallery below and brief video demo after the break.

Microsoft reveals hackers attacked it too, 'no customer data affected'

Following revelations of hackers accessing files at companies including Apple and Facebook, Microsoft revealed today it also found evidence of intrusions. In a blog post on the Microsoft Security Response Center, general manager Matt Thomlinson indicated "a small number of computers, including some in our Mac business unit" were affected by malware of the type described in the other attacks. As he mentions, such cyberattacks are no surprise to a company with Microsoft's profile, however one wonders if the folks in Redmond aren't having a chuckle that Macs appear to have been exploited in this case. He continued to state that the investigation is ongoing, however it does not appear that any customer data was at risk.

Gas prices spike across California

LOS ANGELES (AP) -- It's still February, but California gas prices are springing forward.

The average price of gasoline in the region saw one of the largest one-month leaps since 2000, the Automobile Club of Southern California said Friday. Statewide, the average price of regular gasoline was $4.22, up 12 cents from last week.

Gas prices have spiked between 57 and 59 cents over the past 30 days. The region's largest increase was 70 cents between May and June 2008.

Auto Club officials said the surge can't be attributed to a single factor, but refineries were expected to undergo a heavy maintenance schedule, and large amounts of money have been plowed into contracts speculating that the price of gas and oil will go up.

Californians, however, are used to seeing a hefty price at the pump and might be resigned to paying $4 or more for a gallon of gas.

"We've done this before," said Auto Club spokeswoman Marie Montgomery. "It's definitely not good for consumers."

Last year, for instance, Californians were paying more than $4 a gallon, but there was a slower rise in prices.

Prices in Southern California now nearly match the highest cost for a gallon in the nation, which can be found on Maui. The average price of regular gasoline in the Los Angeles area was $4.316 per gallon Friday; the price in Wailuku, Hawaii, was $4.399.

The price in Los Angeles is 11.3 cents more than last week and 57 cents higher than last month. In San Diego, the average price is $4.285, which is an increase of 10.2 cents from last week and 58 cents from last month.

In San Francisco, the price is $4.22. A week ago, it was $4.08. That price has gone up 56 cents from a month ago.

Montgomery said she bought gas Thursday, and even after a discount, she paid $4.08 per gallon.

"And I should be happy with that?" she said, laughing. "It's frustrating."

Einhorn scores legal victory versus Apple in cash scuffle

NEW YORK (Reuters) - A U.S. judge handed outspoken hedge fund manager David Einhorn a victory in his battle with Apple Inc on Friday, blocking the iPhone maker from moving forward with a shareholder vote on a controversial proposal to limit the company's ability to issue preferred stock.

U.S. District Judge Richard Sullivan in Manhattan granted a motion by Einhorn's Greenlight Capital for a preliminary injunction stopping a vote on that proposal, scheduled for the company's February 27 stockholders' meeting.

The decision could hand Einhorn more leverage as he pursues his pitch for Apple to issue what he has called the "iPref": preferred stock with a perpetual dividend that he contends would reward investors and help boost the company's share price.

Greenlight sued Apple on February 7 as part of a broader pitch to unlock more of its $137 billion in cash. The hedge fund manager has lobbied Apple to issue preferred stock with a perpetual 4 percent dividend, and on Thursday made a direct appeal to shareholders on a teleconference.

Apple Chief Executive Tim Cook last week dismissed the lawsuit as a "silly sideshow."

The lawsuit itself challenged a measure called Proposal No. 2 that Apple put forward, which would eliminate its power to issue preferred shares without a shareholder vote.

At issue is Apple's "bundling" of that measure with two other unrelated matters into a single proxy proposal.

Greenlight said it supported two of the proposed amendments, but not the one on preferred shares.

In his ruling, Sullivan said Greenlight and another investor who also sued Apple "are likely to succeed on the merits and face irreparable harm if the vote on Proposal No. 2 is permitted to proceed."

"We are disappointed with the court's ruling. Proposal No. 2 is part of our efforts to further enhance corporate governance and serve our shareholders' best interests," Apple spokesman Steve Dowling said. "Unfortunately, due to today's decision, shareholders will not be able to vote on Proposal No. 2 at our annual meeting next week."

A spokesman for Greenlight called the ruling a "significant win for all Apple shareholders and for good corporate governance."

But not all shareholders were happy. California pension fund Calpers, a major Apple investor and public supporter of Apple's proposal, said implementation of "majority voting and shareholder approval for the issuance of new stock - preferred or otherwise - is worth waiting for."

"We encourage Apple to reintroduce these measures as soon as is practical so that all investors can be heard," Anne Simpson, Calpers' director of global governance, said in a statement.

BUNDLES

The ruling could be a warning for other companies when issuing proxy proposals, said James Cox, a professor at Duke University School of Law.

"It's going to make managers reluctant to bundle things together, because you're never going to know when you send them out if there's an Einhorn out there," he said.

The lawsuit was centered on a narrow issue of whether Apple violated U.S. Securities and Exchange Commission rules by "bundling" the preferred shares item with two other unrelated matters into one proxy proposal.

Greenlight's lawyers contended the SEC rules were intended to protect shareholders from being forced to vote for a proxy proposal involving materially different issues that the investors might not entirely support.

Apple had argued Proposal No. 2, which only dealt with amendments to its charter, constitute a single matter and wasn't bundled. Sullivan called the company's arguments "unavailing."

"Given the language and purpose of the rules, it is plain to the Court that Proposal No. 2 impermissibly bundles 'separate matters' for shareholder consideration," Sullivan wrote.

Judge Sullivan also found that Greenlight would be irreparably harmed without the injunction, since it would be forced to vote against its own interests. Denying Greenlight's motion would prevent it and other investors from exercising their rights to a fair vote, Sullivan said.

Sullivan separately declined to block a vote from going forward on a separate proxy proposal, Proposal No. 4, which sought an advisory "say on pay" vote on Apple executives' compensation.

The proposal had been challenged by investor Brian Gralnick of Pennsylvania, who contends Apple did not disclose enough details about how it made its compensation decisions.

Sullivan rejected that argument, saying Apple's disclosures were "plainly sufficient under SEC rules."

Arnold Gershon, a lawyer for Gralnick at Barrack, Rodos & Bacine, said he was "very pleased" with Sullivan's decision to the extent it enjoined the Proposal No. 2 vote, though said he would have to decide what to do next with regard to the say-on-pay proposal.

Sullivan directed the parties to submit a joint letter by March 1 outlining the next contemplated steps in this case.

Apple shares closed up 1.1 percent at $450.81 on Friday.

The case is Greenlight Capital LP, et al., v. Apple Inc., U.S. District Court, Southern District of New York, 13-900.

3 political sisters in Pa. convicted of corruption

PITTSBURGH (AP) ? The story has more irony than a Greek tragedy. Three sisters from a devoutly Catholic family have seen their personal and political careers ruined by a scandal that began with, of all things, a letter to some nuns.

Thursday's conviction of suspended state Supreme Court Justice Joan Orie Melvin along with her aide and sister, Janine Orie, on campaign corruption charges mean they might join a third sister ? former state Sen. Jane Orie ? in state prison. No sentencing date has been set.

The former senator was sentenced last year to 2? to 10 years for using her state-paid staff to run her campaigns, though she was acquitted of having them campaign for Melvin, then a lower appellate court judge, who was running for the Supreme Court in 2003 and 2009. Joan Orie Melvin and Janine Orie were convicted in a spinoff investigation and found guilty of similarly misusing Melvin's former staff and the senator's.

Even before the convictions, their careers ? and the family from which they sprang ? were extraordinary.

Dr. John Orie, now 90, and his late wife, Jean, raised nine children including five attorneys, Joan and Jane among them; two cardiologists; a teacher; and a human resources manager, Janine, who worked for her sister Joan Orie Melvin in the lower Superior Court before moving up with her to the Supreme Court.

"It's all pretty unbelievable," said John Burkoff, a university of Pittsburgh law professor who has closely followed the cases. "Whatever you thought about the Orie sisters, whether you liked or didn't like them, you have to look at all of this as tragic."

Jim Roddey is a prominent businessman who heads the Republican Party in Allegheny County, where Republicans are outnumbered more than 2 to 1 by Democrats and where Pittsburgh, the county seat, hasn't elected a GOP mayor since the Great Depression.

Before 2010, when Republican Tom Corbett was elected governor, Jane Orie was the state Senate majority whip ? the highest-ranking elected Republican politician not just in Pennsylvania, but also of several states in the Northeast, Roddey said. And Melvin, elected in November 2009, was one of seven members of the state's highest court.

And now? Jane Orie resigned her Senate seat in May, and Melvin's status on the state's highest court figures to change, one way or another.

State lawmakers have already asked her to resign or face articles of impeachment. If those are approved by the state House, Melvin would be tried by the Senate, which could remove her from office if she hasn't already been removed by the state's Court of Judicial Discipline.

Now that she has been convicted, Melvin has 30 days to respond to charges of misconduct filed with that court by the state's Judicial Conduct Board. If it is determined Melvin has violated professional conduct rules or the state Constitution, or brought disrepute to the judiciary, the court can remove her from office.

Melvin's criminal defense attorneys and her disciplinary court attorney didn't return calls Friday.

The Ories have argued the prosecution is the result of a political vendetta by Allegheny County District Attorney Stephen Zappala Jr., a Democrat, who has repeatedly denied ulterior motives.

When the investigation first became public in late 2009, the sisters claimed they were being targeted because Zappala's family has interests in legalized gambling, which the Ories opposed expanding in Pennsylvania.

The allegations grew uglier, when Melvin ? after it was known Sen. Orie was being investigated but before the justice was charged ? called for an audit of two child care centers that paid kickbacks to two judges in northeastern Pennsylvania's Luzerne County who sent troubled youths to the facilities. The facilities were co-owned by Gregory Zappala, the prosecutor's brother, who was never charged in the scheme and has repeatedly denied wrongdoing.

To this day, some Orie supporters still believe those politics ? not justice ? drove the prosecution.

Roddey acknowledges the sisters' success in a politically hostile environment has something to do with that chatter.

"That's part of it," Roddey said. "But the other half of the equation is that her prosecutor was Stephen Zappala, and Joan's biggest public battle was she chastised the Supreme Court for what happened in Luzerne County."

Whatever the motivations, two juries have now found enough evidence to bring the overachieving siblings from triumph to tragedy despite a raft of supporters ? Sen. Orie spent $420 on a chartered bus to bring 50 character witnesses to her trial ? and, even, efforts to seek divine intervention.

During the investigation, which centered on the sisters' emails, prosecutors stumbled onto messages Sen. Orie and Melvin sent to the "angel lady," a Philadelphia psychic who read her client's written questions aloud before claiming to receive a whispered answer from an angel.

The senator and justice sought assurances from the $85-an-hour medium that Zappala's investigation wouldn't result in criminal charges.

But rather than being touched by an angel, the sisters were undone by some nuns.

That happened in late October 2009 ? days before Melvin won her Supreme Court seat ? when a Senate intern complained to Zappala that Sen. Orie's staff was doing campaign work for Melvin.

The complaint centered on a letter Sen. Orie wrote on Melvin's campaign stationery asking Pittsburgh-area nuns to vote for Melvin.

When Orie and Melvin learned of the whistleblowing intern, the senator had a staffer prepare another letter ? a "cover-up" letter, according to prosecutors. This time, Sen. Orie ? on her own stationery ? spoke about civic events of interest to nuns but didn't mention Melvin.

Prosecutors contend the letter was created to make it appear the intern was simply mistaken about what she saw and was never mailed. Eventually, Sen. Orie's and Melvin's staffs told a grand jury about other illegal campaign work done in Orie's Senate offices and Melvin's chambers.

"Frankly, it's a smart group of people. How could they put themselves in this kind of situation?" Burkoff said. "This is the kind of thing we'll be puzzling about for years."

Former acting SVC president Beckwith found dead from apparent self-inflicted gunshot

BENNINGTON - James Beckwith was found dead Wednesday of an apparent self-inflicted gunshot wound, the same day federal authorities filed a complaint alleging he embezzled $440,000 while serving as acting president of Southern Vermont College.

The Office of the United States Attorney for the District of Vermont filed a civil forfeiture complaint on Wednesday seeking to forfeit assets in the name of James Beckwith, who began working as chief financial officer and chief operating officer for SVC in 2007. Beckwith served one year as acting president beginning January 2012 while President Karen Gross took a leave of absence to work for the U.S. Department of Education.

According to the complaint and an accompanying affidavit prepared by the FBI Beckwith embezzled $440,000 from the school between October 2012 and January 2013. Officials said he allegedly did so by fraudulently inducing college officials to issue three checks in the amount of $100,000, $160,000 and $180,000 to Merrill Lynch. The affidavit states Beckwith told college officials the funds were to be used to settle legal claims arising from a failed dormitory project, however the three checks were actually deposited into a personal account Beckwith shared with his wife at Merrill Lynch.

According to the affidavit, Beckwith used the proceeds of the first two checks, totaling $260,000 to pay down the balances on mortgage and home equity loans on his personal residence in South Londonderry. The complaint

alleges that Beckwith's residence, as well as the money in his Merrill Lynch account, are forfeitable as proceeds of mail fraud and as property involved in money laundering. Federal officials said no charges have been filed and are only accusations. The college began looking into the alleged embezzlement after a financial audit for the fiscal year ending June 30, 2012 found "suspicious financial transactions involving purported vendor payments made by Beckwith," according to the affidavit.

Subsequent investigation into various college bank accounts then revealed the three checks totaling $440,000 that were deposited into Beckwith's personal account. Beckwith resigned effective immediately from SVC Feb. 3 and the affidavit states the FBI was contacted Feb. 8 by legal counsel from the college.

Canon MREAL Mixed Reality headset hitting US March 1st for $125,000

Canon Mixed Reality AR headset rebranded 'MREAL' for US market

This isn't the first we've heard of Canon's Mixed Reality system -- not by a long shot. The company's trotted its augmented reality headset out a few times before. The camera maker did, however, take the opportunity to shed some light on its US plans for the head-mounted display yesterday at an event held in Manhattan's Classic Car Club. Surrounded by the classy convertibles, the company also unveiled the more streamlined (and vaguely Cypress Hill-esque) MREAL name. As before, the headset is decidedly industry-facing, targeting product prototypers with an augmented reality system that lets designers interact with computer-generated versions of their creations before actually willing them into existence.

The MREAL System for Mixed Reality (that's the full name -- or, if you want to drill down even further: the headset is the HM-A1 and the software platform is MP-100) generates video of one's surroundings using a pair of cameras positioned in front of the wearer's eyes, which is combined with computer-generated graphics. The result is displayed on a pair of small monitors "to create high-impact, three-dimensional images." Amongst the potential target audiences for the product are automotive designers, manufacturers, university researchers and museum exhibit curators. Canon's also planning to open up its SDK to developers, so applications will likely only increase.

As per Canon's press release, the MREAL system is set for a March 1st release, priced on a sliding scale, depending on which configuration you opt into -- though the company tossed out the steep $125,000 price point, along with $25,000 in annual maintenance. The aforementioned press release can be found after the break -- or better yet, have a look at our hands-on with the device right now.
