Colo. prosecutors seek execution in theater attack

CENTENNIAL, Colo. (AP) ? For James Holmes, "justice is death," prosecutors said Monday in announcing they will seek his execution if he is convicted in the Colorado movie theater attack that killed 12 people.

The decision ? disclosed in court just days after prosecutors publicly rejected Holmes' offer to plead guilty if they took the death penalty off the table ? elevated the already sensational case to a new level and could cause it to drag on for years.

"It's my determination and my intention that in this case, for James Eagan Holmes, justice is death," District Attorney George Brauchler said, adding that he had discussed the case with 60 people who lost relatives in the July 20 shooting rampage by a gunman in a gas mask and body armor during a midnight showing of the latest Batman movie.

There was no audible reaction from the 25-year-old former neuroscience graduate student, who sat with his back to reporters, or from victims' families in the courtroom. Holmes' parents sat side by side in the gallery, clutching hands with fingers intertwined.

The decision had been widely predicted by legal analysts.

Within minutes of its becoming official, the trial was pushed back from August to next February and Judge William B. Sylvester removed himself from the case, saying that now that the charges carry the death penalty they will take years to resolve and he does not have the time to devote to such a drawn-out matter.

Despite the potential for more delays, some of those who lost loved ones were happy with prosecutors' decision.

"I had a huge adrenaline rush," said Bryan Beard, whose best friend Alex Sullivan was killed in the attack. "I love the choice. I love it, I love it." He added: "I hope I'm in the room when he dies."

But the prospect of a longer legal battle troubles others such as Pierce O'Farrill, who was shot three times.

"It could be 10 or 15 years before he's executed. I would be in my 40s and I'm planning to have a family, and the thought of having to look back and reliving everything at that point in my life, it would be difficult," he said.

Legal observers said Holmes' lawyers publicly offered a guilty plea in what may have been a bid to gain support among victims' families for a deal that would spare them a painful trial and lengthy appeals.

The prosecution and the defense could still reach a deal before the case goes to trial.

Holmes' lawyers have indicated in court papers that they may instead pursue a defense of not guilty by reason of insanity. But that carries great risk: Prosecutors could argue that Holmes methodically planned his attack, casing the theater, stockpiling weapons and booby-trapping his apartment with explosives.

If he is found not guilty by reason of insanity, he will be sent to the state mental hospital, then returned to prison after treatment.

Colorado has three people on death row but has executed just one person over the past 45 years, in 1997.

The judge newly assigned to the case, Carlos Samour Jr., is considering whether a New York-based Fox News reporter should have to testify about how she obtained confidential information about Holmes.

Jana Winter cited anonymous law enforcement officials in reporting that Holmes had sent a psychiatrist a notebook of drawings that foreshadowed the attack. Holmes' lawyers want to know who told Winter about the notebook, arguing that that person violated a gag order.

The massacre helped lead to passage in Colorado last month of new gun control measures, including a ban on the sort of high-capacity magazines that Holmes allegedly used to spray the theater with dozens of bullets in a matter of seconds. Seventy people were injured in the attack.

President Obama is scheduled to visit Denver on Wednesday to highlight the legislation as part of his push for more gun control following December's school massacre in Connecticut.

Online Behavioral Advertising - Chapman Law Nexus Journal

Privacy is ?the right to decide when, how, and to what extent information about [yourself] is communicated to others.?[i] Although the umbrella of privacy law covers many distinct legal concepts,[ii] with the rise of online behavioral advertising, the right to control the dissemination of information about you has become an increasingly important aspect of law. Online behavioral advertising is the practice of tracking an individual?s Internet use and using that information to target them with advertisements based on that information. With the rise of online behavioral advertising,[iii] companies have been tracking everything from an individual?s browsing history to GPS location using information from consumers? smart phones and computers.[iv] In 1972, California citizens amended the State Constitution and added ?privacy? as an inalienable right.[v] Based on this added right, California enacted the Shine the Light Law, the California Security Breach Information Act, and the Online Privacy Protection Act to try and protect consumers from invasion of privacy online by different entities.[vi] The Shine the Light Law requires businesses to provide customers with a list of certain information that they share with third parties for the purpose of the third party?s direct marketing purposes, upon request by the customer.[vii] The California Security Breach Information Act requires that companies notify consumers if there has been a data security breach that may have compromised the security of certain types of personal information (i.e. a consumer?s name in connection with a Social Security number, credit card number, Driver?s license number or medical information).[viii] For both statutes, violation by the governed entities can open the door for a claim of injunctive relief by a harmed consumer, and damages may be awarded for willful, intentional, or reckless breaches of the Shine the Light Law.[ix] The Online Privacy and Protection Act requires companies and websites to make their privacy policies available to the consumers so they are aware of what information is being collected about them, how it is being used, and who can access it.[x]

The problem however, is that many consumers are still unaware that the practice of collecting and selling personal information and Internet usage patterns is taking place, and if they are aware, it is difficult and sometimes impossible to prevent the collection and sharing of his or her data.[xi] The current debate surrounds the extent of privacy regulations. The back-and-forth is between privacy advocates calling for increased government regulation,[xii] and Internet companies calling for self-regulatory principles as a remedy for privacy concerns.[xiii] Privacy advocates do not believe that self-regulation has worked thus far, and therefore the government should place affirmative duties on companies who handle, collect, or sell personally identifiable information (name, address, etc.) and non-personally identifiable information (GPS location, music interests, etc.) to allow consumers to opt-in, as opposed to having to opt-out of the collection of that information. Internet companies argue however, that increased regulation will stall innovation and hurt their ad-revenues, possibly leading to an Internet where you have to pay for the services you desire. On one hand, in California, courts have repeatedly affirmed the importance of an individual?s right to privacy.[xiv] Conversely, courts and legislatures are reluctant to enact legislation that places large administrative burdens on companies or that squanders innovation. Given the number of Internet companies based in California,[xv] the state is caught in a unique bind between preserving the rights of the public, while enacting laws that will not compel these corporations to move elsewhere. Going forward, California will need to continue to balance these interests in light of the constantly evolving Internet world.

Firefox G-Fox: Plush Edition (hands-on)

With the introduction of Google's Chrome and stepped-up games from the likes of Internet Explorer and Safari, Firefox is arguably not quite the darling of the browser wars it was when it first hit the scene in 2003. And while Mozilla has certainly made progress on that front, the organization understands that diversifying is an important factor in the future success of the company, first through Thunderbird and more recently through the Firefox OS, a mobile operating system targeted toward users in developing nations. G-Fox, meanwhile, marks a decidedly different direction for the foundation, which has made its name in the world of software. It's an adorable attempt, perhaps, to take the world's bedrooms and playrooms by storm.

The plush is the real-world port of G-Fox, Mozilla Online China's large-headed, big-eyed take on the American mascot, Kit. The fox was first spotted in the wild at last year's Mobile Asia Expo in Shanghai. Mozilla Online wasn't talking it up too much at the event, but naturally, we couldn't wait to get our hands on an early build. And for a first-generation product in a new space, we have to say, in the whole time we've been playing around with G-Fox, we've yet to encounter a single crash or slowdown in spite of extensive squeezing, head patting and tossing up in the air, adorably.

Storm Threat Tonight, Tomorrow

They have dropped the Watch box for our area.

EASTER STORMS AHEAD

Overnight toward ?tomorrow morning (Easter Sunday sunrise: 7:18) we have a severe weather threat. A cold front sweeps in from the the northwest producing a complex of storms ahead of it. ?They arrive in the 3am-7am window into north Texas. There should be another round of storms along the actual frontal passage later in the morning as well. Damaging wind and large hail will be the main threat by these storms.

We will be staffing the CBS11 Weather Center overnight and into tomorrow morning. I?ll be here until 3am; Garry Seith will relieve me and stay until the severe weather threat ends in the morning.

Easter Sunday services means a large number of people on the roads in the morning; we all need to be keeping a watch to the skies.

MORE RAIN, THEN MORE COLD

We are still watching a major pocket of cold air to come down from the northern plains and invade Texas by Tuesday. We have excellent rain chances to start April with; both Tuesday and Wednesday look to be cold and wet. Overnight lows won?t get down into the ?late frost? range but highs will only be in the 50?s.
